2008년 12월 2일, 자신의 스물일곱 번째 생일인 이 날에 브리트니 스피어스는 6집 앨범 Circus를 발매했다. 이 음반은 대부분 호평을 받았고, 메타크리틱에 따르면 평균 100점 만점 중 64점을 받았다고 한다. Circus는 발매 첫 주 빌보드 200(미국)에서 약 50만 5천 장을 판매해 1위로 데뷔하였으며, 캐나다 및 체코에서 1위로 데뷔를 하였고 많은 유럽 국가에서 상위권으로 데뷔를 했다.Circus는 그 해 가장 빨리 팔린 음반이기도 했다. 그리고 이 음반은 전 세계적으로 4백만 장 이상 팔렸다.
첫 싱글 "Womanizer"는 공개된지 2주 만에 미국 아이튠즈에서의 약 28만 6천 건의 다운로드 횟수에 힘입어 "...Baby One More Time" 이후, 9년 만에 빌보드 싱글 차트 1위를 차지했다. 미국 이외에 벨기에, 캐나다, 덴마크, 핀란드, 프랑스, 노르웨이와 스웨덴 등 많은 국가에서 정상을 차지했다. 또한 이 노래는 제52회 그래미상 최우수 댄스 레코딩 부문에 후보로 오르기도 했다. 2009년 3월부터는 The Circus Starring Britney Spears 투어를 시작했다. 미국 전 지역에서 티켓 판매가 시작된 지 며칠이 지나지도 않아 전 좌석 매진이 되는, 20대 가수로서는 세계적으로 이례적인 콘서트 티켓 판매가 이루어졌다. 브리트니는 이 투어를 통해 찬사를 받으며 2009년 가장 성공적인 콘서트 다섯손가락에 꼽히기도 하였다. 또한 호주에서는 4일간 총 60,247만 장의 티켓을 팔아 쟁쟁한 가수들을 제치고 신기록을 수립했다. 투어의 총 수입은 1억 3천만 달러로 그 해 가장 높은 수익을 올린 다섯 번째 투어였다. 하지만, 투어 중 대부분의 노래를 립싱크로 불러 비난을 받았다. 호주에서는 일부 팬들이 100만원대가 넘나드는 가격에 표를 구입해 버지니아 저지 호주 뉴사우스웨일스 주 공정거래 장관은 "입장권 가격이 장당 200달러든 1000달러 이상이든, 우리는 팬들이 당초 실제 지불하려 했던 금액에 표를 구입했는지 확인하고자 한다"고 말해 문제를 제기했다.
